Mrs. C – Orthopaedic Medical Negligence

Mrs. C pursued damages for personal injury and related losses due to negligent medical treatment following a fracture of her left radius. 

After suffering a severe left distal radius fracture and a wound on her wrist, Mrs C underwent surgery at Scunthorpe Hospital (Northern Lincolnshire and Goole NHS Foundation Trust). She continued to suffer pain and numbness in the affected limb and was referred for follow-up care at a specialist centre in Leeds.

At the Trauma and Orthopaedics Clinic, Mrs. C was seen multiple times for investigation and treatment but continued to experience pain.  She required further surgery to remove metal work and associated screws, which were alleged to be too long. The negligence in her initial treatment significantly impacted Mrs C’s career as a professional singer. 

Independent expert evidence was obtained from a Professor in Hand and Wrist surgery.  The professor supported the claim but noted that damages would be limited as the severe injury was likely to have long term consequences even with appropriate treatment. 

Liability was denied and the matter progressed towards trial.   The parties ultimately reached a settlement of £11,000.
